Child Support in Texas

Generally, child support is a court ordered payment from one parent to another parent to help pay the child’s living expenses and costs. The child support amount is calculated using the Texas Child Support Guidelines. Various factors are considered when calculating child support according to the guidelines and when calculating child support to ask for an amount that is more or less than guideline amount. When calculating guideline child support the following factors are considered.

  • The paying parent’s net monthly income;
  • The number of children involved in the case;
  • The child’s medical or dental insurance premium costs; and
  • Whether the paying parent has the legal duty to financially support another child.

One of the most contested issues in a child support case is what financial resources count towards determining the paying parent’s gross monthly income used to calculate child support.  Texas law states what resources are included as income and what resources are not.

Resources included as income are:

  • W2 income including commissions, overtime pay, tips, and bonuses;
  • Interest dividends and royalty income;
  • Self-employment income:
  • Net rental income
  • All other income actually being received such as severance pay, retirement benefits, pensions, trust income, annuities, capital gains, Social Security benefits other than Supplemental Social Security Income, United States Veterans Affairs Disability Benefits other than non-service connected disability, unemployment benefits, disability and workers compensation benefits, interest income from notes, gifts and prizes, spousal maintenance, and alimony.

The court can consider circumstances of the parents and child to determine whether the guideline child support amount is inappropriate and, therefore, order another child support amount.  Also, the court can order retroactive child support for the time period for up to four years before the child support case is filed.
